Credit check when paying a lease in advance

My wife and I are temporarily moving into an apartment while we look for a home to purchase. We are willing to pay for a 6 month lease in full up front, and do not want a credit check done. (Too many inquiries on your credit report have a negative effect and we are buying a house soon.) We are finding that apartment leasing offices are still insisting on the credit check, even though they are not extending credit. Is this legal, especially considering privacy issues?

Why not bring them a recent credit report that you obtained. I did that, and they accepted it.
