Legal Question in Landlord & Tenant Law in California

Cutting weeds on acreage rental propety

I rent a house on almost 3 acres in California. I agreed that I would cut the weeds every year, but it has come to my attention that I am only responsible to cut them 100 feet from my house. Is this true? Thank you

Re: Cutting weeds on acreage rental propety

You may be mixing apples and oranges here. If your lease provides that you will clear the weeds on all three acres every year, what California law provides in terms of brush clearance is probably irrelevant. If, however, your lease provides that you shall maintain "adequate brush clearance," then you may be able to get away with the 100 foot requirement which is set forth in CA law. You need to review your lease for how this obligation was worded. You may only be obligated by state law to maintain 100 foot clearance, but you may have a lease obligation that requires the full lot to be cleared, in which case your lease would prevail, and you would be required to continue to clear the full lot.
