Legal Question in Landlord & Tenant Law in California
A daughter (25), her boyfriend (30) and their child (4) live with her parents. The mother wants them to leave. They have lived there off and on for a year or so, but have never paid rent. This is in California. Does the mother have to evict them? If so, is it a 30, 60 or 90 day eviction?

If they have never paid rent, they are guests and not tenants. If the mother calls the police to evict them with no notice at all, she would be well within her rights.
