Legal Question in Landlord & Tenant Law in California
deduction from security deposit
My ex landlord is deducting carpet cleaning in the amt of $85. I lived in apartment for 1 1/2 years. Left apartment in excellant condition. Can I sue in small claims for this or does he have the right to charge me for the cleaning of the carpet. The carpet wasn't cleaned when I rented and I left no damage just normal wear and tear. ???????????????? Thks Sandra

Re: deduction from security deposit
Certainly you may sue the landlord in small claims court if you feel the landlord unjustifiably withheld money from your security deposit.
Be prepared to present evidence to establish the condition of the apartment when you moved in and when you left.
