deposit to hold a rental property

I gave a deposit to a rental agency to hold a house until after they did a credit check. They said it was refundable if I wasn't accepted for the rental. I was accepted but at a higher rent rate per month. I don't want the house for more money. Can I get the deposit back?.

Based upon the facts presented, I would agree that you should get your money back. The deposit was for the house at the specified rent. Since they are not willing to offer it at that rent, they should no longer hold your deposit and should be content to rent it to someone else at a higher rent.
