Legal Question in Landlord & Tenant Law in California

Deposit

When I moved into my Apartment 4 years ago my then roomate and I split the First and Last which was $2000 altogether. A year later my roomate moved out. I have been there ever since. I have had different roomates come and go. I never had any one else put up a deposit, because it was already there. I am going to move soon. My landlord told me that his Son, who was the landlord when I moved in, gave my first roomate the deposit back. I said, ''What are you talking about? No none notified me of this. Do you have a receipt for the transaction?'' He does not have a receipt, and looked dumb-founded. Since I am on the rental agreement, and no one else, arn't I entitled the the deposit? Is it legal for him to give my deposit away while I am still a resident? Any info would be appreciated. Thank you.

Re: Deposit

Since you and your then-roommate split the $2,000 deposit, you are entitled to 1/2 that or $1,000.00. It's up to your roommate to obtain the other half, if he has not already. Good luck.
