Legal Question in Landlord & Tenant Law in California

Can I get these documents?

Say I am a defendant in california. Is there any way to get documents from the other party in my case that will help me? For example, rental agreement? I lost a few documents I really need!

Re: Can I get these documents?

You have not indicated the nature of your case in which you are a defendant. Based on the fact that you are a defendant and are seeking a rental agreement I susppect it may be an unlawful detainer aciton.

If this is the case, the rental agreement should be attached as an exhibit to the unlawful detainer complaint.

Re: Can I get these documents?

This is one of the reasons lawyers are necessary! You can do a document request pursuant to Code of Civil Procedure section 2031.010 and subsections that follow. You might be able to find the skeleton online or in a form book at your local law library. If, as Mr. Pinette suspects, it's an unlawful detainer, the plaintiff would have five days (plus five for mailing the request) from the date of service to answer and provide the requested documetns.
