Legal Question in Landlord & Tenant Law in California
My next door neighbor has told me that her landlord (we're in a condo complex)has threatened to evict her if she will not sign a form saying she pays a lower rent than what she does. The landlord wants some sort of a tax benefit.What is this "benefit" and what can be done about this?

Call the IRS and report the landlord's dishonesty. The IRS should be very interested in this landlord. I would not sign anything that is not true. Your neighbor can ask to take the document so he/she can have his/her attorney look at it. Never sign and return it if it is not true.
People who report tax fraud are supposed to receive rewards from the IRS. I believe that you can report anonymously, however, if the landlord takes it to trial, it won't be so anonymous then. Also, if your neighbor reports his/her landlord to the IRS or if your neighbor refuses to sign something that is untrue, and if an eviction ensues, please contact a landlord-tenant lawyer. Your neighbor would have remedies for retaliatory eviction. Always keep copies of all letters your neighbor writes to the IRS and/or to the landlord so that your neighbor can prove retaliatory eviction.
