Legal Question in Landlord & Tenant Law in California

The duplex I live in was just sold. The old landlord will not give my deposit to the new landlord nor is he going to give my deposit back to me. Doesn't he have to give the deposit to one of us?

Yes, because when he sells the duplex he is selling all of its assets which includes your security deposit. Either one of you could sue him successfully, but it is probably best to leave it up to the new landlord.
