Legal Question in Landlord & Tenant Law in California

right of entry after vacating

My roommate moved all of her belongings out and now keeps coming back with the police to enter the apartment because she is on the lease even though she paid for August rent. She says she is on the lease so she has the right to come in even though she broke her portion and left not fulfilling her end of the lease. She got a free month and did not fulfill her full term of the lease. She only paid for 5 months not the 6 shse has been there. Does she have any right to enter and keep coming back? She has nothing there it is just to try to get me evicted so she can get out of the lease.

If she abandoned the property and moved out, she is no longer on the lease, especially if she isn't paying for it. If she wants to stay on the lease, she'll have to pay her share or get a release from the Landlord. You should change your locks and inform the landlord that he needs to give your ex-roomate release. Good Luck.
