Legal Question in Landlord & Tenant Law in California

How would I evict my ex-girlfriend and mother of my child. She moved into my back house with my dieing mother that I let live with me in her last days. I did not want to create problems when my mother was alive I wanted her last days to be peaceful, so I allowed her to live there because I felt my mother wanted her to live there so her granddaughter was there full time. My mother has since past away and my ex is still living in the back house. I can not stand to live with her anymore, she does not pay rent there was no lease agreement (She really was never suppose to move in). I can not stand to let her live in my house. I want to do this the right way so it does not come back to haunt me.

How do I get her out of my house?

Hire an attorney, have them prepare notice and have her served, then if she fails to move after notice is given, have the attorney file an unlawful detainer lawsuit. In situations like this, you really do need to have an attorney handle it - both to distance you from the case - it will get ugly; and to make sure it is done right the first time around. You really don't want to live with her if you don't handle the case properly and wind up losing an eviction. It will get exponentially harder to evict her if you have an eviction botched and lost.
