Can i evict my tenant?

i live in house and one of the rooms is being rented, Im asking the tenant to vacate the room giving--name removed--month notice, she said that she will not pay the monthly rent for that particular month because its the law? is that true, but its my house and its not rental property. Or I just can actually ask her to vacate the room asap?

You should give 3 days notice if the rent is not paid, and then file unlawful detainer if still not paid.

She DOES owe monthly rent for the last month, and you can evict, however, if she stays you will have to deduct any unpaid rent from the security deposit.
