Legal Question in Landlord & Tenant Law in California
Being evicted, rent was paid
Can a landlord evict you if you have paid your rent for the last 6 months but they didn't cash m/o, I do have receipts. Had a 60 day notice to get out but marshalls were there at 45 days with red tag on property, locked out and was told would get arrested if trespassing Landlord has been running ads for the last 30 days for new tenants. A comment was made by the property mgr that thet can get more money from new tenants because they can only raise the rent 10% at a time. Landlord entered the locked residence without notifying tennants before the red eviction notice was placed. Tennant was given 15 minutes to clean out a 3bdrm 2ba home. Landlords attorney said he served eviction notice, but tennant was never given any document, the eviction notice found on garage floor.

Too little too late. You can sue in civil court for damages against the landlord, but, you need to find a place to live first. If the Marshall is already involved, that means the unlawful detainer judgment has already been ordered by the court. Please consult a local attorney to assist you. Good luck and thanks for inquiring.
