evicting a relative

My sister moved into my home last July. There is no written/signed agreement. She agreed to pay me $600 per mo for rent on the room including utilities. The situation has not worked out, and I gave her a 30-day notice to vacate on 02/05/2009. As of this date she has not moved out, and she stopped paying me. How do I get her out of my house?

You have an oral lease agreement with her. As she has not yet moved, you will want to file an Unlawful Detainer action in the local Superior Court. You would be best served to be represented by counsel in a matter such as this - in part to ensure it is handled correctly, however, in larger part to insulate yourself from your sister to a degree. It will make your life a whole lot easier to say that you are simply following the advice of your attorney in proceeding to evict her.
