Legal Question in Landlord & Tenant Law in California
Eviction with Altered Lease
My former landlord evicted me after I was unable to pay the rent after my husbands untimely death. I could not locate the original lease in all my paperwork to take to court. The lease she used in court was altered denying me of the $3500.00 security deposit. After all is said and done and she won the case and used a false document to achieve the outcome she wanted. Can I resubmit the original lease (which she faxed to me) to the court based on new evidence?

You could file an ex parte application to shorten the time to hear a motion to reconsider, based upon new evidence that was unavailable at the time of the hearing -- especially since she had withheld it from you. That should be done immediately.
