Legal Question in Landlord & Tenant Law in California
Eviction
I was never given a 3day pay or quit notice but I was served with an Eviction notice. What are my rights as a tenant? I had a flood in my apartment 30 days ago it is still not repaired. I sent a letter to owner and now I am being evicted for not paying my rent, they have my rent check. I am filing a response. My question is what do I put in my answer to the court.

Re: Eviction
You can include affirmative defenses such as: constructive eviction caused by the flood, offset for destruction of your personal property, cost of alternative housing, health hazard caused by mold and mildew, etc.
