We would have to know if there is a lease. Without a lease, a 30 or 60 day notice may be served. If the tenant still does not move, an unlawful detainer would be filed. We can answer any questions you might have.

The law calls this person a private lodger, rather than a tenant.

If there are no other lodgers, you evict by giving notice equal to the amount of days between rent payments. If lodger won't leave, you have him/her charged with trespassing. You don't need eviction papers.

If there are other lodgers, then the one you wish to evict is treated like any other tenant. You give 30 days notice, and then file an unlawful detainer.
