Legal Question in Landlord & Tenant Law in California
Eviction
Can I evict a tenant and have it say''effective immediately''?
A Care-Provider that we know asked if one of her patients could rent our motor home.We agreed. She told us he had cancer and is recovering from treatments and needed quiet.day 4,5 and 6, she isn't returning his calls, or ours, he doesnt like being alone, and is knocking at our door all day. Last evening he hands us a suicide note saying he's going to take all his meds and kill himself. And says it out loud for our 10 and 11 year old to hear.
we took him and the note to the hospital. they 51-50'd him. It's not cancer he has, he a mental case. Help

Re: Eviction
You have a very delicate situation here. The disabled tenant is protected by fair housing laws. Evicting him because he is disabled would violate fair housing laws. You can get into very serious and extremely expensive trouble.
Your obligation is to make a reasonable accommodation to your policies when necessary to allow a disabled tenant to use and enjoy the premises and facilities on the same terms as tenants who are not disabled. You did the right thing to secure medical help for him.
There is no simple solution to your problem. The courts have said each situation must be considered on its individual facts. You should seek legal advice about your situation. The general answers you can expect on a web site like this will probably not be enough to answer your problems.
