Legal Question in Landlord & Tenant Law in California
Eviction- grounds for dismissal
I have been served with an unlawful detainer by my landlord. He gave me the detainer three days after I provided him my rent. I did pay the rent late but I did let him know I would be paying it late three weeks before. I was never actually served with the papers directly. They were left in my doorway. The papers show the wrong address and it is not marked off the method of delivery. My question is: Are these grounds for the case to be dismissed or thrown out?

Re: Eviction- grounds for dismissal
There could be a number of grounds for dismissal. Did he give you a 3-day notice to pay or quit? If the address is incorrect, the document is defective on its face, and subject to a motion to quash.
