Legal Question in Landlord & Tenant Law in California

Eviction Summons and Complaint Service

I filed an Unlawful Detainer law suite. I then had the Serrif's Department go to serve the Summons and Complaint. Before the tenant could be served, they moved out of the rental unit and I have no forwarding information. What do I need to do now as far as the court is concerned?

Howdy:

If they've moved out, which is really the point of the UD action ... to gain possession, then there is no longer an issue; unless you're still interested in a money judgment for back rent, &c.

Probably, the best course is to dismiss the UD. Contact the Court and the Sheriff's Department. You can also report the deficiency to the credit bureaus through the tenant tracking company you use.

Hope this helped.
