Expired Lease Roommate Problem - Please Help!

Hello Everyone.

I am living in CA (SoCal) with a terrible roommate. Thank god my lease will expire in AUG 2008. Both of us are on the original lease.

I am planning to MOVE OUT! I never want to see my roommate again. But then my Land Lord tells me that I CAN NOT move out ''fully'' with no rental obligations if my roommate does not move out with me.

I just want to move out when my lease is up (AUG). I thought I DO NOT need to worry about my roommate and his activities. I was thinking my side of the obligations are over.

Is this true!? am I forced to be stuck with my roommate unless he agrees to move out with me or signs a new lease with just his name on it? so I can live free??

Please Help.

It depends on your lease agreement. If both you and your roommate signed the same lease agreement, then you may be held responsible for your roommate's rent, although you could sue your roommate for reimbursement. If you signed separate lease agreements, then your landlord probably cannot hold you liable for your roommate's rent.

You need to give written notice to your landlord and roommate that you will be moving out.
