Legal Question in Landlord & Tenant Law in California
expired lease sublet roommate wants to stay
I signed a lease with two other people. After the lease expired, one of them moved out and someone else moved in. No agreement was signed. He has been living here for a year and a half. The other original tenant and I want to move out and get our deposit back but he doesn't want to leave. If I can't get it back, can I just inform the landlord that I am leaving and not be legaly or financially (i.e. credit hits for possible late payments or damages made after I am gone? I live in Los Angeles. Thanks!

If you signed a lease you are legally responsible for rent, unless you have an agreement with the landlord for a sublessor.
If you have additional questions you should contact any attorney in your area.
Good luck.
