Father needs to evict son

My husband has been dealing with his non-cooperative son, who lives in our rear house.He has given his son numerous chances to get his finances together(son can't keep a job!), in order to maintain his agreed upon rent.He has been living behind us for about 4 1/2 yrs. My husband has given him both 30-day and 60-day notices to pay or quit.The son responded by saying ''he's not going anywhere''.Is there a law which states that ''a landlord(father)cannot evict a tenant(son)because it's a family dwelling place''? and when is it necessary for a tenant to ask the landlord for ''renter's assistance'' ($$)? Thank You

If he is over 18 and is not on title to the property, he can be evicted like any other tenant. "Renter's Assistance" comes from social services agencies, not landlords. Make sure that you are not in a rent control area, but if he isn't paying rent, you can evict.
