how do you file a small claim and can you get the fees waived?

You go down to your local courthouse and go to the clerks office and ask them for the papers to file a small claims action. Fill out the paperwork and give back to the clerk with the fee. If you want the fee waived you will have to fill out a fee waiver form which should also be available from the clerk.
In many counties they have a small claims advisor who can offer some limited assistance with what you have to do.
