Legal Question in Landlord & Tenant Law in California
I filed a small claims against landlord for my deposit for which he never returned or sent a list of damages or fees for what he would take out of the deposit. it has been 4 months since i moved out. He has been served papers and now says he will counter-sue for say a utility bill not paid and a hole in wall. Is that possible?

Yup. You can sue for the return of the entire security deposit, if your landlord did not send you a timely statement, regarding the dispositon of your deposit. That does not stop the landlord for suing you for amounts which you allegedly owe. When you go to court, you will iron out who owes what to whom.
