Legal Question in Landlord & Tenant Law in California

Three Fold Question

Dear Sirs,

My father is the landlord of the building that I live in

thus, I don't pay rent. all of the tenants are having problems with cockroaches in the apartment, mine seems to

be the worst. I am not the Julia Child of housekeeping, I do

admit that I could be much more tidy, and I have a floor

where the wood is starting to rot.(I have a washing machine

in my unit. I had a few floods with the washing machine,

but this was not done out of malice and intent . My father

and I have been estranged for three months andI wrote him

about my situation because I need to go on welfare , he financially cut me off. I need income coming in . I left my

job, the situation was not tolerable. He said I can do what I want regarding having the social worker come in and see

the apartment. He said , the Social worker will report me

and force me to leave the apartment. Also, he said that

I willfully mistreated the apartment and if I don't get

my act together , I will be thrown out. My question is does

he have the right to throw me out.

Re: Three Fold Question

Yes. It is his property and you are a tenant, unless you have some ownership interest in the property. He must, of course, abide by the law and notice requirements before starting eviction proceedings. Good luck and thanks for inquiring.
