I just found out that my landlord has lost her homes via auction. I have been served a three day Quit notice to vacate the property.

I have a 12 month lease through 04/10 .

What are my rights?

You should call the person named at the bottom of the three-day notice and tell him/her that you have a written lease. If they ask, you should provide them with a copy. Some counties or cities that have rent stabilization ordinances prohibit eviction just because the property has been foreclosed. Other areas are silent about it, but require a 30- or 60-day notice, depending on how long you've been in the property. If you are unable to reach anyone by telephone, immediately send a certified, return receipt letter (keep a copy) informing them of your tenancy and providing them with a copy of your lease. That letter will be Exhibit "A" to your defense in any unlawful detainer based upon a 3-day notice.
