Legal Question in Landlord & Tenant Law in California

Garage assigned to the unit

A new neighbor below me moved in and told me point blank that I should be getting a notice any day that I will have to move out of my garage that I have had for years to give to him because it is a handicap garage. This issue came up once before and the management did not ask me to move but assigned a parking spot outside that was marked handicap. In my community certain apartments are given a garage for an additional $50.00 that is included in the rent. This garage unit is on my original lease. The new resident has an assigned garage also, and just like the neighbor above me who moved in after me who treid toget my garage, she got a handicap parking spot outside instead by the building and their other vehicle is parked in the regular garage. Can they legally make me give up my spot? Also, I have many boxes and items that are allowed in my garage that would require me to move and possibly have to get storage for because it is quite a bit larger than the others. Let me know how to handle this. It doesn't seem right to do that to a resident who has been here for years especially when it has occurred before and they made a different arrangement.

Thank you,

Sufani

Re: Garage assigned to the unit

Dear Sufani:

There is no particular law that covers this, so you should read your lease carefully and see if any of the provisions fit this situation.

You mention that the garage is in the original lease, but if the lease says "A" garage instead of "your particular" garage, it is going to be up to management.

I wish you the best of luck in handling this.
