Legal Question in Landlord & Tenant Law in California

I gave my month to month renter a 30 day notice which had a clause that said he must pay

the prorated amount of rent up to the 30 days. He is not living at my home, but all of his

stuff is still there. He comes and goes when I am at work. The 30 day notice expires on

Saturday. Can I move his stuff out of the room and change the locks. He has not paid the

prorated rent and owes for damages.

It sounds like you have a lodger, not a tenant, but your facts are not clear enough to tell. Without knowing which he is, there is no way to answer.
