Legal Question in Landlord & Tenant Law in California

We gave notice to not renew our lease on a small business back in July. The lease ended on August 31st. Landlord agreed to month to month extension while we remodeled our new location. Landlord put a note in our statement saying we had to be out by end of Sept. We never open our statements - we just send a check - so we find out they have a new tenant about 1 week ago. We need the building until the of Oct to complete our remodel. What can they do if we don't move out? Please advise soonest.

He has to serve you with an unlawful detainer suit; he can not get a judgment to remove you before the end of October, but you should try to work out some type of settlement wilth him to avoid litigation and the effect on your credit of a suit being filed against you. If before he sent to you the notice that you did not read all of you had agreed that the monthly extension would last for more than one month then he can not change the agreement unilaterially by telling you to leave earlier.
