Legal Question in Landlord & Tenant Law in California

We're giving 30 day notice before the end of the current month (on a month to month tenancy), and we already paid for our "last month" during move-in (not part of the security deposit). Will we be owed a prorated refund? For example, we give notice today, Aug 15, that Sep 15 will be our last day; we paid for August, and our "last month" partially overlaps with August�are we owed a refund for that overlap?

You should be if it was for rent. Some landlords call a security deposit "last month's rent" and there is a statute that governs what a security deposit can be used for, including unpaid rent.
