Legal Question in Landlord & Tenant Law in California
Giving notice
I have given a 30 day notice to vacate my apartment. My girl friend is staying with me until the new place is ready (she is not on the month to month). She has been staying with me for about 8 days. Our new place will be ready in 2-days. My landlord stopped by last night at about 9:00 p.m. and handed me a 3-day notice. Because she was not on the lease & her car is parked in one of my additional spaces. Can the landlord do this? What recouse do I have?

Re: Giving notice
I need more information. What did the three day notice say (there are 3 different types)? What date does your 30 day notice expire? Are there any other problems from landlord, other than this?Does your lease specifically state that no one else may be living, or staying with you? Is your rent current? Answering your questions: yes, the landlord can do this. He already did! Do you have recourse? Yes, but I need the above questions answered first. Also, what is your rent, and what is the deposit? Let me know the ansers to these questions, and I'll do my best to help you. Finally, if your new place is ready in two days, why is it important that he wants you out in three days?
