how do you get a guest to leave your house when they refuse to leave. they don't pay rent, theres no written agreement, they have been there over 6 months, and the have polluted your property with more of their personal things than they said they had. they have taken over . how do I make them leave your house legally

I would suggest first informally addressing it with the "guest". If he/she doesn't leave, then serve a formal, written 30-day notice to quit. There are many examples on the internet. Then, if the person doesn't leave after 30 days, he/she would be guilty of an infraction. You would call the Sheriff, have the Sheriff come out, and escort the "guest" away from the premises, permanently. You would have to give the person legally appropriate notice regarding the personal property left behind and, perhaps store it until the time has run. See Code of Civil Procedure section 1946.5 and Penal Code section 602.3 for more information.
