Legal Question in Landlord & Tenant Law in California

Hello,

My wife and I co-signed a year long apartment lease on 8/1/2010. She just left the apartment and is refusing to pay her half of the rent. Our landlord informed her (in writing) that she is still responsible until the lease term expires on 8/1/2011. How can I get her to pay?

You cannot force her to write a check. You can sue her for breach of contract if the two of you had an agreement that each would pay half of the rent. However it would take time to sue her and win and even if you win you would have to collect the judgment from her. There is no quick way to force her to pay her portion if she will not do so voluntarily.
