Legal Question in Landlord & Tenant Law in California

Hi,

I had been staying with a friend for the past month and a half. Two weeks ago we had a falling out and she locked me out of the apartment then proceeded to go out of town for 2 weeks. She is now telling me that if I want to see any of my belongings again I am going to have to pay specified fees that she has come up with and thinks are justified. For example she said if I want my bed back I am going to have to give her $350 for that item alone. On top of that she is going to come up with a list of fees she expects me to pay for any damages she believes I may have caused to any item of her property. She continues to tell me If I do not pay her demands she is going to sell all of my possessions. So my question to you is what are my rights, how may I get my things back and is it within the law for her to do this to me?

She has no legal right to do it. Based on these facts you would have the alternative to plead in repleven or conversion. Repleven is a pleading to claim the right to get the things back. Conversion is to force her to pay you the value of the things she took. If you plead in repleven, you could also plead for an injunction against her disposing of the items.
