Legal Question in Landlord & Tenant Law in California
I'm hoping you can help me with something. I'm 19yrs old and attending college in CA. This is my second year. I'm renting an apartment with someone. She's my age. My roommate has been very difficult to live with. She smokes marijuana everyday in our apartment. Initially, she had agreed to smoke in her room. But now she smokes in the living room and other shared areas. The smoke makes me sick. I'm also concerned about this being an illegal activity and don't want to be connected to it as I do live there too. She also has guests stay over for weeks at a time which is against our rental agreement. And the guests smoke too. I've tried discussing these issues with her multiple times but she ignores me. Our lease is effective until 8/2014. Is there a law that would allow me to break my lease early without penalties? If so, what can I do to remove myself from this situation? What should I do? I would like to move out. I've asked my landlord for advice and possible options but she said she is unable to help. Please help. Thank you for your time.

Give her a written notice to cease and desist. If she doesn't report her to the police if you believe she is using the substance illegally. You can also get a restraining order against her.
