Legal Question in Landlord & Tenant Law in California

Illegally sub-divided unit eviction

I signed a 1 year lease and was evicted 1 month later due to the

unit not being up to codes. The city building inspector informed the

landlord that his property was illegally sub divided and was in

violation of several codes as well. It was really a house that he

divided into 2 apartments illegally 11 years ago. When asked the

landlord said he forgot and he evicted me. Do i have a case for

breach of contract? I am on disability and moving twice was

extremely hard on me. Thank You

Re: Illegally sub-divided unit eviction

Yes. You have a case for breach of contract and should be entitled to your rent and deposit back. Your landlord misrepresented the habitability of the unit. How is it that you were ''evicted''? did the landlord sue to have you removed?
