Legal Question in Landlord & Tenant Law in California
keys
when the new landlord took over the property in 7/05 they required all the tenants to give them copies to thier apts. Now again they are demanding keys to my apt again and saying if not recieved by3/18/08 it will be a breech of contract and I will be charged for the cost of changing the locks. I don't have a problem with them having the keys to my apt. I feel that sinse I already gave them a set and they do not know where theyb are or who ended up with them that they should pay to have the locks changed out because if they no longer have them or know where the keys are or who has them then that is thier fault they do not have a set of keys to my unit and I shouldn't have to pay to change the locks now that I know there is a set of keys to my apt. that is unknown where they are or who has them. what can I do

Re: keys
You do not say it directly, but I assume you do not what to give them a current key to copy. You are also willing to fight them over this issue, even though it might mean they will be less disposed to look kindly upon you in deciding whether to keep you as a tenant.
Send them an e-mail or note that yuou have always been willing to co-operate with them, but you are scared thtaawith a key some where in the hands of someone who is not supposed to have it, keeping the current key presents a danger to you. They have the obligation to pay for the new lock set since had they not lost the key none of this would have arisen. they have a duty under the contract to supply you with a safe place, and one where the key is missing is not safe.
