hi, I am a landlord in california, my house rented to a section 8, she did not pay her rent and garbage fee. After I gave a 3 days notice, how soon I can give a 30 days notice to terminate the tenancy? if she pay the rent or garbage fee after I gave her the 30 days notice, am I still able to have her to move or when I can process to eviction her? pls advise. thanks. You have to read the section 8 lease very carefully, as they contain very specific provisions regarding eviction of tenants who default in paying rent or any other obligation. As a general rule, you do not need to give a thirty day notice after the expiration of a valid three day notice to pay or quit, but again, it is fact specific to your lease agreement with the tenant and the County Housing Authority. You should probably have an attorney work with you on the eviction from the very start - including the notice to terminate, as all eviction - and particularly those of subsidized tenants - require strict adherence to the laws right down to the contents and service of the notice terminating tenancy.
