can a landlord charge up and above the security deposit

Can a landlord charge and collect for damages to your apartment that are more than your security deposit (ie.. bleach stain on the carpet or walls painted a tan color). Also, can your landlord makes repairs without giving you an itemized statement of charges or receipts for repairs?

Yes, he can charge you for for any damages that you have caused, even if above the security deposit. However, he must give you an itemized statement of the damages and receipts for the repairs.

You are required to receive a move out statement with the itemization for repairs applied to your deposit under Civil Code Section 1950.5. You can be sued for more than your deposit if you caused damage. We will have to review the charges and move out statement if you received any to help you determine if the charges are reasonable.
