Legal Question in Landlord & Tenant Law in California

Landlord discrimates against me

I own a mobile in a mobile home park in which I pay space rent. I have had several problems with this landlord. He bought it seven years ago, and the park has gone downhill since then. I have had to contact the FAA because he landed his helicopter 20 ft from my house, and haveeven had to deal with damage fom the fire his employee set. He only uses a PO box and will not pick up certified letters and refuses my delivery conf. letters as well. He is resurfacing the park, and according to residency law, he is responsible for fixing my driveway. I sent a letter to management asking for him to fix it (it has gaping holes anybody could easily trip on). He sent me a letter back stating that he looked at it, and it didn't need to be repaired, then told me I was damaging his driveway with oil. I called the manager and demanded he come and point out the alleged oil, of which he could not. I don't know how he checked it with both my large truck and my car occupying the space. I told him that other driveways have oil, and he told me that he wasn't going to compare them. Apparently it's only what I do that matters! I could go on and on about other things he has done to me, but I don't have space. What can I do to get my driveway repaired?

Re: Landlord discrimates against me

Send the landlord both a certified letter, and a copy by regular mail. Tell him you will repair and deduct the cost from rent, and give him reasonable period of time. The courts usually accept that delivery is made by this method, even though he won't sign for certified.

You can also withhold rent (after your letter), but you must give reasonable time for him to repair.

You can sue him in Small Claims court.

You can move.

You can have a lawyer write a strong letter threatening a lawsuit.

Good luck!
