Legal Question in Landlord & Tenant Law in California
My landlord "evicted" me for the most ridiculous reasons. For not vacumming my room, talking on the phone till midnight and I left the fan on a couple time in my room which she helped herself in numerous times. ANyways, I gave her a $300 security deposit for the room. The room is still in the same condition it was when I moved in. I have only been there a month. Even though I was evicted can I still get my security deposit back?
1 Answer from Attorneys
Regardless of how you left (eviction or voluntarily), your landlord has an obligation to account for the use of your security deposit or return it within 21 days of the date you left.
