landlord reclaiming property

daughter lives in a studio apartment. This stuido was originally a garage. Owner of apartment complex is being told by the city to put the studio back to a garage. owner was made aware of this 09-2006, gave my daughter eviction notice 3-1-07. Does she have the right to keep any of my daughters $1000.00 deposit. my daughter lives in torrance california, im her mother and i live in bakersfield, im on the rental agreement also, it was a month to month agreement.

My suspicion is that the garage/studio was never registered with the city as a rental unit. (I had the same situation with a landlord client.) Therefore it probably would be illegal, and the landlord never should have collected rent. Your daughter (and you) might speak with the city attorney's office about at least getting her deposit back if the landlord refuses.
