In California, if a lease agreement expires but the tenant remains as a renter of the premises, then it is a tenancy of month to month, with either side having the right to give 30 days notice to the other that a new monthly contract will not be agreed to. If you do not pay rent for the full 30 day period of time, the landlord can sue you for the balance. Unless he agrees to use some other time period, you must give thirty days notice to leave.
