As a landlord, can I sue for carpet replacement cost due to tenant illegal smoking? Don't know how to prove it. Reator who brokered the lease is a witness. She suggested replacing the carpet to get rid of the horrible odor. The carpet was 3.5 years old before and 5 years old after tenant moves out.

If the lease prohibited smoking and the carpet can not be de-oderized, then that would qualify as abnormal wear and tear. But you also need to depreciate the value of the carpet in determining what to charge the tenant.
