Legal Question in Landlord & Tenant Law in California
landlord/ tenant notice for construction
I received a single notice, slipped in my mailbox, dated 8-1-07, regarding an asphalt slurry seal project. The front page of the letter stated when the construction was going to occur and where. The construction date, 8-15-07 at which my car was towed stated that garage 148 to parking space 0588 would be involved. My space is #2031, which according to the letter would be included in the second construction date 8-22-07 for garage 148 through parking space 2037. I did not notice the backside of the page, which stated that vehicles left parked in the designated areas will be towed at the vehicle owners expense. I did not know that my car was going to be towed. I wasnt even informed about who I should call for my car. The posting in the mail room does not show the backside of the letter, which informs us of the towing and is behind glass. The second attached page had a map of the construction sites, but it was difficult to read and interpret the numbered spaces so I stuck to the written letter. Because of this incident, I payed $260 to take my car out of the tow site and an additional $20 for a parking violation I received from parking right outside the complex overnight because of the consruction. What can I do?

Ms. Healy's answer is right on target.
I am sure the management/owner followed the law, and you just missed it.
You can sue in Small Claims Court, but, in my opinion, are unlikely to prevail.
