Legal Question in Landlord & Tenant Law in California
Landlord/ Tenant
I am on the Section 8 program in California, I moved into my house before the contract was finished with section 8, which leaves me to pay the owner back rent, i have lost my job and am now on welfare, i have not had any success with getting any child support help for my 2 kids, I have told the landlord that i just do not have extra money to start making payments on the back rent not until i can find a job again but everyday she is calling me and asking me when am i going to start paying her the back rent, I am still unemployeed and going to school to try and help me get a job i have applied everywhere fast-food places anything to get more money to help me pay her and to help take care of my childeren and me. She does not care i feel harassed by her everyday. I do pay the current rent it is just that i have no money to start making payments on anything else I pay all the bills and everything, and there is just never any extra money. What can I do? I just don't know what to tell her amymore?

Re: Landlord/ Tenant
I am very sorry to hear of your situation. Frankly, there is nothing you can do legally to prevent her from evicting you if she chooses not to work something out. I would just continue to try and work something out with her, or sadly you will need to start looking for a new place to live. Its a terrible situation, but unfortunately, the landlord is probably not in the business of charity, she is in the business of making money or, as with many landlords, just breaking even. While the situation is not fair to you, it is similarly not fair to the landlord to have to wait to get paid money they are owed. This is a situation where nobody wins. I am sorry I don't have any better advice for you, but there really isn't anything you can do to force the landlord to hold off collections. Have you spoken to the local housing authority, the City and/or local nonprofit organizations to get some assistance? I know here in San Clemente, we have a faith-based nonprofit that helps individuals, and if you lived in San Clemente, they might advance some of what you owe to the landlord and get it back once you are employed. I'd go talk to the City housing department, and ask if they, or a local nonprofit can help you out. Good luck.
