Legal Question in Landlord & Tenant Law in California

Landlord Threatening Me

When I first moved into my apartment my landlord and I were members of the same church. Now that I don't attend church she has been going out of her way to make things difficult for me. She has told my son he will burn in hell, she ripped bumper stickers off my car, she threatened to evict me if I don't get rid of my cat (I don't have a cat), she has also threatened to evict me for having patio furniture which my lease says I can have, she parks in my space and then tells me if I park anywhere else she will have my car towed as well as several other things. Now she is threatening to call CPS and tell them my kids are in danger because I will teach them ''false docterine'' and she is also threatening to contact the military and tell them my husband is causing problems. My husband is in Iraq and could not be doing anything to her. My question is: Is there a way to legally get out of my lease and get out of this situation?

Re: Landlord Threatening Me

Yes!

You need to file in small claims court with a complaint that you landlord has broken the right you have to quiet enjoyment of your premises. This abuse gives you the right to break the lease.

A certified letter should be sent to landlord, followed by your complaint.

Re: Landlord Threatening Me

In addition to what Bob Bennett recommends, could you talk to the minister about the landlord's bizarre conduct and threats, and seek his/her advice or counsel?
