my landlord told me to get rid of my dog with in 5 days, a the month to month contract that was signed state that a 9 year old boxer is to be allowed on the premises. exact words on the contract state line number 12 unless otherwise provided in california civil code SS54.2, no animal or pet shall be kept on or about the premises without landlords prior written consent. Except: the dog mentioned above
now she is trying to charge a $ 500 on top of the rent agreed on for not get the dog out. with in 5 day. I live in the city of la puente, ca zip code is 91744 please let me know my rights.

Since the parties are allowed to agree to any terms not against public policy or the law, if the lease says the dog is permitted then it is and a higher than previously agreed to rent can not be charged. but since you are on a month to month rental, they can just give your thirty days notice [60 days if you have lived there more than one year] that they choose not to renew the lease and you have to move.
