Landlord will fix leak, but will also raise rent to do so

Hot water in my bath tub is running (more than a drip)constantly. Ask my landlord if he could fix it and he told me no. Because the plumber charges him $80 everytime they have to come out. He then told me that he would fix it, but he would also raise my rent every year. Can he do this?

Can I fix and deduct from rent?

You can certainly fix it and deduct from the rent. He can't evict you because that would be retaliatory. Mind you, before you hire the contractor, make sure that you notified the landlord in writing that there is a leak and if he doesn't fix it, then, you will have fixed and deduct. He can't raise the rent unless the lease is expired. And, he can only raise the rent if it doesn't violate any rent control laws. Good luck and thanks for inquiring.
